Family Files Lawsuit Against Norwegian Cruise Line Over Child’s Alleged Misdiagnosis at Sea

When someone becomes seriously ill during a cruise, passengers expect the ship’s medical center to quickly recognize the problem and provide appropriate care.

A new lawsuit filed in federal court claims that didn’t happen aboard Norwegian Aqua, where a Washington family alleges a delayed diagnosis turned a medical emergency into a life-changing ordeal.

Jennifer Hampshire has filed a maritime medical malpractice lawsuit in the U.S. District Court for the Southern District of Florida on behalf of her minor child, accusing NCL (Bahamas) Ltd. and two shipboard physicians of failing to properly diagnose and treat appendicitis during a recent cruise.

The lawsuit alleges those failures ultimately resulted in a ruptured appendix, emergency surgery after a medical evacuation, and permanent injuries.

At this stage, these are allegations contained in a civil lawsuit. The court has not ruled on the claims, and Norwegian Cruise Line has not been found liable.

Lawsuit Describes Multiple Visits to the Ship’s Medical Center

According to the complaint, the child sought medical care several times while onboard after developing severe abdominal pain accompanied by repeated vomiting.

The lawsuit states that medical staff documented symptoms that allegedly became increasingly consistent with appendicitis as time passed.

Among the symptoms referenced in the filing were abdominal tenderness, fever, worsening pain in the lower right side of the abdomen, and laboratory results showing elevated inflammatory markers.

Despite those findings, the family claims the child was initially diagnosed with acute gastritis and discharged from the ship’s medical center on more than one occasion.

The lawsuit alleges the child’s condition continued to deteriorate until it became impossible to stand without assistance.

Only then, according to the complaint, was a medical evacuation arranged so the patient could receive shoreside treatment.

Doctors at the land-based hospital reportedly determined the appendix had ruptured, requiring emergency surgery.

Family Alleges Ship’s Medical Department Was Not Adequately Prepared

Beyond the treatment itself, the lawsuit argues that Norwegian Cruise Line failed to provide medical facilities capable of handling serious emergencies aboard a modern cruise ship carrying thousands of passengers and crew members.

The complaint alleges the company did not adequately staff or equip the onboard medical center and claims the ship lacked sufficient diagnostic resources needed to quickly identify conditions such as appendicitis.

Among the allegations raised are concerns involving:

  • Staffing levels within the medical department.
  • Availability of diagnostic equipment.
  • Access to medications.
  • Resources needed to evaluate emergency cases.

The filing also references previous lawsuits involving medical care aboard Norwegian Cruise Line ships, arguing those earlier cases should have alerted the company to alleged deficiencies within its shipboard healthcare system.

Those prior lawsuits remain separate legal matters, and the current complaint relies on them to support its arguments regarding notice and corporate responsibility.

Doctors Named as Defendants in the Complaint

The lawsuit names two physicians who allegedly treated the child aboard Norwegian Aqua.

According to the complaint, the family contends the doctors and other medical personnel failed to recognize a progressively worsening emergency despite symptoms that, in the plaintiff’s view, pointed toward appendicitis.

The filing further alleges that Norwegian Cruise Line failed to properly hire, supervise, and retain qualified medical professionals capable of managing both pediatric and adult emergencies at sea.

Among the claims included are allegations involving:

  • Negligent hiring.
  • Negligent retention.
  • Inadequate emergency training.
  • Insufficient clinical experience.
  • Failure to maintain appropriate professional qualifications.

These allegations have not been proven in court and will likely be examined as the litigation moves forward.

Cruise Line Also Faces Claims Based on Responsibility for Onboard Medical Staff

One of the key legal issues in the lawsuit concerns whether Norwegian Cruise Line can be held responsible for the actions of the ship’s medical personnel.

The complaint argues that passengers reasonably believed the doctors and nurses were acting on behalf of the cruise line because the medical center operated under Norwegian branding, treatments were charged directly to passengers’ onboard accounts, and the medical department was presented as part of the ship’s services.

Based on those allegations, the family is pursuing several legal theories that seek to hold the cruise line responsible for the alleged negligence of its onboard medical staff.

The lawsuit requests compensation for damages that include:

  • Past and future medical expenses.
  • Alleged permanent physical injuries.
  • Emotional distress.
  • Future economic losses.
  • Loss of enjoyment of the cruise vacation.

The amount of damages sought has not been publicly determined.

Medical Care at Sea Can Present Unique Challenges

Cruise ships are equipped with medical centers designed to treat many routine illnesses and stabilize more serious conditions until patients can reach a hospital if necessary.

However, ships operate in environments where advanced diagnostic capabilities may be more limited than those available at major medical centers on land.

When physicians believe a passenger requires specialized treatment unavailable onboard, cruise lines can coordinate emergency evacuations by helicopter or transfer patients to hospitals at the next available port, depending on the ship’s location and the urgency of the situation.

Cases involving alleged delays in diagnosis often become highly fact-specific, with courts examining medical records, expert testimony, staffing, available equipment, and the decisions made by healthcare providers based on the information available at the time.

Case Will Be Decided Through the Court Process

The lawsuit is now pending before the U.S. District Court for the Southern District of Florida.

As with any civil litigation, the allegations outlined in the complaint represent the plaintiff’s version of events.

Norwegian Cruise Line and the other defendants will have the opportunity to respond through the legal process, and the court has not reached any conclusions regarding liability or damages.

The case will now proceed through the normal stages of federal litigation, including the exchange of evidence, witness testimony, and additional court filings before any final determination is made.
