What should have been a relaxing day by the pool aboard Carnival Magic has now turned into a major legal battle for Carnival Cruise Line.
A Florida passenger has filed a lawsuit seeking more than $5 million in damages after claiming he suffered painful second-degree burns simply from walking across the ship’s pool deck barefoot.
The case is drawing attention because most cruise-related injury claims involving pool decks usually focus on slips and falls—not scorching hot surfaces.
The lawsuit raises a bigger question that many cruisers have asked for years: Can cruise ship decks become dangerously hot under the Caribbean sun?
Passenger Says Short Walk Led to Painful Injuries
According to court filings, Florida resident Jorge Luis Alverio Nunez claims he was injured while sailing aboard Carnival Magic on May 21, 2025.
The guest alleges that after leaving the pool area, he walked roughly twenty steps across the Lido Deck to reach his lounge chair, where his shoes had been left nearby.
During that short walk, he says the deck surface was so hot that it caused serious burns to both feet.
Nearly a year later, on May 11, 2026, he officially filed a maritime injury lawsuit in federal court in South Florida.
According to the complaint, the injuries were severe enough to require hospital treatment and allegedly resulted in ongoing pain, mobility challenges, and permanent physical effects.
Key allegations made in the lawsuit include:
- The deck surface reached unsafe temperatures.
- Carnival failed to adequately warn passengers.
- Crew members allowed guests to continue using the area despite potential risks.
- Preventive measures were not taken to reduce deck temperatures.
- The passenger suffered significant physical and emotional damage.
The lawsuit seeks compensation exceeding $5 million.
Could a Cruise Ship Deck Really Get That Hot?
One of the central arguments in the case revolves around whether Carnival should have known the deck surface posed a danger to guests.
While exact weather conditions on the day of the incident haven’t been released publicly, late May is typically one of the hotter periods for Caribbean and Bahamas cruises.
Temperatures frequently reach:
- Mid-to-upper 80s°F in the Bahamas.
- Upper 80s to low 90s°F in many Caribbean destinations.
Under direct sunlight, ground temperatures can often become dramatically hotter than the surrounding air temperature.
However, cruise ships are somewhat different from land-based surfaces.
Constant ocean breezes, water splashing from pools, and specially designed marine decking materials are intended to help minimize heat buildup.
Carnival uses professional marine-grade flooring products that are designed to remain cooler and provide slip resistance.
Even so, many cruisers have long reported that certain deck areas can become uncomfortable—or even painful—to walk across barefoot during extremely sunny days.
Lack of Warning Signs Becomes Major Issue
Another major focus of the lawsuit involves warnings—or the alleged lack of them.
The passenger claims there were no signs posted near the area advising guests that deck surfaces could become dangerously hot.
He also alleges that no announcements were made warning passengers to wear footwear when walking around the pool area.
This could become an important legal issue because warning guests about a known hazard is often a key factor in determining liability in personal injury cases.
While some Carnival ships have occasionally displayed caution signs regarding hot deck surfaces, the lawsuit argues that those warnings are not consistently used across the fleet.
Other Carnival Guests Have Reported Similar Complaints
This isn’t the first time passengers have raised concerns about hot pool deck surfaces.
Over the years, social media has featured numerous complaints from cruisers who said the decks became almost impossible to walk on comfortably during sunny afternoons.
One Carnival guest posted online several years ago describing the deck as “scalding,” adding that many parents were carrying children across certain areas to protect their feet from the heat.
Other passengers have shared similar experiences, noting that:
- Pool decks can become extremely hot during sea days.
- Children are often most affected because of sensitive skin.
- Some guests keep sandals close to pool chairs specifically for crossing deck areas.
- Water shoes have become increasingly popular on Caribbean sailings.
While these complaints don’t necessarily prove the deck surfaces are unsafe, they do suggest the issue is familiar to many repeat cruisers.
Carnival Encourages Guests to Wear Protective Footwear
Carnival’s own guidance recommends that guests wear appropriate footwear around outdoor areas of the ship.
Popular options include:
- Boat shoes
- Sandals with grip soles
- Water shoes
- Pool-friendly footwear
Although water shoes cannot be worn inside pools or hot tubs for safety reasons, guests are free to leave them nearby and put them back on when moving around the ship.
Many experienced cruisers already follow this practice, especially during midday hours when deck temperatures tend to peak.

At this stage, the lawsuit remains in its early phases, and Carnival has not publicly commented on the allegations.
The cruise line has also not released any statement regarding the reported deck temperatures aboard Carnival Magic or the specific incident described in the lawsuit.
For now, Carnival Magic continues operating its regular Caribbean cruise schedule from Miami without any changes.
As the case moves through the courts, it could potentially shine a spotlight on an issue many cruise passengers have quietly discussed for years—whether cruise lines should be doing more to protect guests from deck surfaces that can become surprisingly hot under the tropical sun.
